[00:00]
Islam does not allow child marriage.
[00:02]
>> It in fact does.
[00:04]
>> Let me debunk this for you. So people
[00:05]
say Aisha who married Prophet Muhammad
[00:07]
peace be upon him was 9 years old when
[00:09]
they got married. Yes, this is true.
[00:10]
>> Well, then you've already destroyed your
[00:12]
own argument. And technically the
[00:13]
traditional account is worse than how
[00:15]
you presented it because Sahi Abakati
[00:17]
says that the marriage was contracted
[00:18]
when she was six and was consummated
[00:20]
when she was nine. So six at the
[00:22]
contract, nine at the consummation when
[00:24]
your prophet engaged in sexual
[00:26]
intercourse with the 9-year-old who
[00:27]
you're saying is not a child. But we
[00:29]
also have in the text that she was past
[00:31]
the age of maturity. We know that she
[00:33]
was mature.
[00:34]
>> Okay, show us. Because you don't have
[00:36]
that. There is no hadith that says Aisha
[00:38]
possessed adult mental maturity or gave
[00:40]
informed adult consent. Your text simply
[00:42]
do not say that. You added that because
[00:44]
the actual report is indefensible by
[00:46]
every possible modern standard. Again,
[00:48]
the authentic Hadith Bkati literally
[00:50]
places this narration under a chapter
[00:52]
that's titled giving one's young
[00:54]
children in marriage. Other hadith and
[00:56]
canonical reports describe her playing
[00:58]
with her dolls and playmates.
[00:59]
>> And in Islam, you are not allowed to
[01:01]
marry a woman until she is past the age
[01:03]
of maturity and mentally there. A child
[01:05]
is not mentally there.
[01:06]
>> I agree. A 9-year-old is not mentally
[01:08]
there and you have no sources. You have
[01:10]
no authentic text, anything like that
[01:13]
that indicates that Aisha was mature.
[01:15]
>> Now, fun fact, what most people didn't
[01:16]
know is she was engaged before she got
[01:19]
married to Prophet Muhammad peace be
[01:20]
upon him, right? Does a child get
[01:22]
engaged and then marry someone? No.
[01:23]
>> Yeah. This means nothing because
[01:24]
historically children were in fact
[01:26]
betrothed all the time. And your logic
[01:28]
is completely backwards because if
[01:29]
Aisha's marriage to Muhammad was
[01:31]
contracted at six, then any previous
[01:33]
engagement happened when she was even
[01:35]
younger than that. Your own sources call
[01:37]
her young. Okay? You're the one that's
[01:38]
trying to redefine her as an adult. Your
[01:40]
original sources and scholars don't say
[01:42]
that. What you're doing in this video is
[01:44]
not proving that Aisha wasn't a child.
[01:46]
No, you're trying to change the
[01:47]
definition of what an adult is. Also
[01:49]
note, puberty, even assuming that it had
[01:51]
occurred with Aisha, is not the same
[01:53]
thing as adult mental capacity. A
[01:55]
biological change doesn't suddenly give
[01:57]
a 9-year-old in the 7th century the
[01:59]
judgment of an adult. As for you saying
[02:00]
that in Islam, you're not allowed to
[02:02]
marry a woman until she's past the age
[02:04]
of maturity and is mentally there,
[02:05]
that's wrong, too. That's simply false
[02:07]
as a description of classical Islamic
[02:09]
law.
[02:09]
>> Islam does not allow child marriage. If
[02:11]
you look into the hadith, if you look
[02:12]
into the Quran, there is nothing in the
[02:14]
religion that allows you and says that
[02:16]
it is halal and permissible to marry a
[02:18]
child.
[02:19]
>> That is a lie. Quran 65:4. What you will
[02:22]
read here is that there is an
[02:23]
established divorce waiting period
[02:25]
referred to as ana for females who have
[02:27]
not yet menrated. The classical
[02:29]
commentators such as Iben Cir explicitly
[02:31]
understood that to include young girls
[02:33]
who had not yet reached ministration.
[02:35]
The classical jurists then used that
[02:37]
passage along with Aisha's marriage when
[02:39]
ruling that guardians could arrange
[02:41]
marriage for minors. The Quran doesn't
[02:43]
need to contain the exact modern English
[02:45]
sentence. Oh, child marriage is a law.
[02:47]
That's not how legal interpretation
[02:48]
works.
